Ms. Borgerson has represented clients in both state and federal courts, in arbitrations and mediations, as well as in front of government agencies, such as the Equal Employment Opportunity Commission, Maryland Commission on Civil Rights and Office of Administrative Hearings. Ms. Borgerson’s litigation experience includes defending and enforcing employment agreements, including restrictive covenants, defending employers in wage and hour matters, and defending against discrimination and harassment claims. This experience enables Ms. Borgerson to better counsel businesses on ways to avoid potential risks that frequently lead to litigation. To that end, Ms. Borgerson acts as outside general counsel to small and mid-sized companies in an advisory capacity in all aspects of corporate law, including the formation and organization of new entities, employment agreements, employee handbooks and other employment policies, issues related to the hiring and firing of employees, business transactions, and other employment matters.
In addition to her business and employment practice, Ms. Borgerson regularly represents clients in fiduciary disputes involving trusts, estates, wills, and guardianships. She has successfully litigated a wide range of matters, including actions seeking the removal of trustees and personal representatives, as well as will caveats and challenges to the validity of trust instruments based on undue influence or lack of capacity.
While an experienced litigator, Ms. Borgerson also recognizes that litigation is not always the most effective path to resolution. She works closely with clients to identify opportunities for negotiated solutions and has successfully resolved numerous complex fiduciary disputes through settlement agreements between fiduciaries and beneficiaries, helping clients protect their interests while avoiding the time and expense of protracted litigation.
Ms. Borgerson was selected as a Super Lawyers Rising Star from 2020-2023. In 2022, she was selected by The Daily Record to be on its “Business and Employment Law Power List,” which includes 25 of the top business and employment attorneys in Maryland.
